You’re not at fault. Your car is wrecked. You’re hurt. Then you learn the other driver has minimum limits or no insurance at all. This is where your coverages matter.
What UM/UIM actually is
Uninsured Motorist (UM) steps in when the other driver has no liability insurance.
Underinsured Motorist (UIM) helps when the at-fault driver’s limits are too small to cover your losses. Many policies package them together. MedPay can also help with immediate bills regardless of fault (it doesn’t replace UM/UIM), but it buys time.
Georgia vs. Arizona: Key differences that matter
- Comparative fault: Georgia is a 50 percent bar state. Hit 50 percent fault and you recover nothing. Arizona reduces your recovery by your percentage of fault but doesn’t bar it.
- Stacking in Georgia: “Add-on” UM stacks on top of the at-fault limits; “reduced-by” UM fills the gap up to your UM limit. The policy language controls which you have.
- Policy wording controls in both states: Endorsements and declarations decide whether coverage stacks and how offsets apply. We read every page.
- Deadlines: Most injury claims use a two-year clock, but UM/UIM can have contractual deadlines that are much shorter. Some carriers require very prompt notice and sworn proofs. Government claims run on even shorter notice rules so say something early.
Hidden policies you can miss
Household and resident-relative UM/UIM policies, employer vehicles, ride-share coverage, credit-card or umbrella policies. We look everywhere before anyone says, “There’s no coverage.”
Traps that shrink UM/UIM claims
- Recorded statements. Adjusters ask questions that shift blame or minimize injuries. Call us first.
- Broad medical releases. A blanket release invites fishing into unrelated years. We narrow the scope.
- Gaps in treatment. Skipped visits become “proof” you weren’t really hurt. If cost or rides are the problem, tell us—we’ll help keep care on track.
- Premature releases. Don’t sign any release until we confirm the impact on UM/UIM and other coverages.
