Either driver can be at fault in a T-bone crash—the driver who got T-boned or the driver who “did” the T-boning. For example:

  1. Driver A runs a red light, T-boning Driver B, who had the right of way as they crossed the intersection (Driver A is at fault);
  2. Driver A is obeying traffic laws while going straight through a four-way intersection, but Drier A has no stop sign. Driver B pulls out from a side street at that four-way intersection, failing to yield the right of way, and gets T-boned by driver A. In this case, Driver B is at fault.

As such, the police cannot assume that because you got T-boned, the other driver is at fault. The same is true if you were the driver who T-boned the other—you or the other driver could be at fault.
